Nowoursynowska 147/ 4 (postal code 02-776), entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw, XIII Commercial Division of the National Court Register under the number KRS 0001017896, NIP 9512561083, REGON 52440099800000, registered in the Insurance Agents Register under the number 11256670/A (hereinafter: “INS Global”).
1. Definitions
- Visa Insurance – the brand consisting of the name Visa Insurance and the graphic symbol (logo), placed on the Visa Insurance Service and its documents, brochures, graphics, other marketing materials, as well as visual and communication elements, being the property of INS Global and protected by copyright.
- GTC – general terms and conditions of insurance available on the Visa Insurance Service, regulating the conclusion and performance of the Insurance Agreement, the rights and obligations of the parties to the Insurance Agreement, as well as the method of payment of benefits by the Insurer.
- IPID – a standardized document specifying the most important information about the insurance; created for each insurance based on the GTC.
- Policy – an individualized document with a unique number, created using the Visa Insurance Service, confirming the conclusion of the Insurance Agreement.
- Privacy Policy – a document constituting an integral part of the Terms and Conditions, specifying the principles of collecting, processing, storing, and protecting the User's personal data.
- Terms and Conditions – these “Visa Insurance Service Terms and Conditions” concerning the provision of electronic services. They are made available via the Visa Insurance Service in a form that allows them to be downloaded, recorded, reproduced, and printed. The Terms and Conditions specify:
- the type, scope, and technical conditions for the provision of electronic services,
- the conditions for accepting Applications for the conclusion of Insurance Agreements via the Visa Insurance Service,
- the method of concluding a Distance Insurance Agreement,
- the conditions for making payments for the Insurance Premium,
- the principles and procedure for complaint handling.
- Insurance Premium – the fee for insurance calculated based on the insurance parameters entered into the Visa Insurance Service.
- Visa Insurance Service – an organized IT and information platform connected to the Internet, prepared and made available by the owner of the Visa Insurance brand, enabling Users to use IT mechanisms and information developed by the owner of the Visa Insurance brand, available on the website visa-insurance.pl and visa-insurance.eu. The Service contains documents, graphics, and other works protected by copyright, as well as trademarks.
- Insuring Party – a natural person, legal entity, or organizational unit without legal personality, which has concluded an Insurance Agreement with the Insurer.
- Insurer – an entity conducting activities involving the provision of insurance services in accordance with applicable law, on behalf of which, based on the received power of attorney, the owner of the Visa Insurance brand, INS Global, performs agency activities; depending on the type of insurance, information about the Insurer can be found in the Visa Insurance Service, GTC, IPID, and Policy.
- Insurance Agreement – an insurance agreement concluded with the Insurer via the Visa Insurance Service; the content of the insurance agreement is regulated by the GTC and the Terms and Conditions, which form its integral part.
- User – any natural person, legal entity, and organizational unit not being a legal entity, which is granted legal personality by law and is capable of using the Visa Insurance Service under civil law.
- Application – an application for the conclusion of an Insurance Agreement, filled out by the User in the Visa Insurance Service with data necessary to conclude the Insurance Agreement, after a prior calculation of the Insurance Premium.
2. General Provisions
- Based on the Terms and Conditions and GTC, the owner of the Visa Insurance brand, INS Global, provides electronic services enabling the User to use the Visa Insurance Service, within which it is possible, among other things, to conclude an Insurance Agreement and make a payment for the Insurance Premium on the terms specified in the Terms and Conditions.
- Each User, in order to use the Visa Insurance Service, consents to the processing of their personal data to the extent and under the conditions specified in the Privacy Policy.
- Acceptance of the Terms and Conditions can be expressed by the User explicitly by confirming this fact or implicitly if the User continues to use the Service after becoming familiar with the Terms and Conditions.
- Payments are handled by PayU S.A. with its registered office in Poznań (60-166), at 186 Grunwaldzka Street, KRS: 0000274399.
3. Conditions and technical requirements for using the Visa Insurance Service
- To use the Visa Insurance Service, the following are required: Internet access and a web browser enabling the activation of JavaScript and cookies.
- The site contains PDF documents, which require the installation of an appropriate application to open them.
- Documents, particularly the Policy, may be encrypted or placed in an encrypted archive (e.g., ZIP). Information on how to use the password and open them will be provided to the User upon the conclusion of the Insurance Agreement.
- Data entered in the Application, transmitted using the form, is protected by using a secure Secure Socket Layer (SSL) protocol.
- A condition for concluding an Insurance Agreement is the provision of an email address by the User in the Application.
4. Conclusion of an Insurance Agreement in the Visa Insurance Service
- The principles of concluding and terminating, including the cancellation of a given Insurance Agreement, the subject and scope of insurance, the period for which a given Insurance Agreement may be concluded, the rights and obligations of the parties to the given Insurance Agreement, and the conditions for its performance, including information on the benefits due, are specified in the GTC.
- The User, after specifying the requirements and needs, indicates in the Application the insurance period, the purpose of the insurance, the type and variant of insurance to obtain a calculation of the Insurance Premium.
- The User, after accepting the calculation of the Insurance Premium and selecting the scope and variant of insurance, fills out the Application with the data of the Insuring Party and other data necessary to conclude the Insurance Agreement with the Insurer. The User is responsible for the improper, incorrect, untrue, or incomplete filling of the data.
- Before sending the Application and paying the Insurance Premium, the User should familiarize themselves with:
- the amount of the insurance premium,
- the content of the GTC and IPID,
- the content of the Terms and Conditions,
- the content of the Privacy Policy.
- Payment of the Insurance Premium occurs at the moment the Insurance Premium in full amount is credited to the account of the entity providing payment services to INS Global, if the User uses remote payment.
- The conclusion of the Insurance Agreement occurs by sending a correctly filled-out Application via the Visa Insurance Service, making the appropriate statements, and paying the Insurance Premium via the entity providing payment services to INS Global.
- In case the Application is sent without the Insurance Premium, the Insurance Agreement is not concluded.
- Confirmation of the conclusion of the Insurance Agreement is made by generating and sending the Policy to the email address provided by the User in the Application. The User consents to receive the Policy and other insurance documents to the email address provided in the Application.
5. Withdrawal from the Insurance Agreement
- The Insuring Party who concluded the Insurance Agreement via the Visa Insurance Service for a period longer than six months may withdraw from it within 30 days from the date of its conclusion. In the case of an entrepreneur – this period is 7 days.
- If the Insuring Party was not informed about the right of withdrawal at the latest at the time of concluding the Insurance Agreement, the 30-day period runs from the day the Insuring Party learned about this right.
- A written statement of withdrawal from the Insurance Agreement should be sent to the address contact@visa-insurance.eu
- Exercising the right of withdrawal from the Insurance Agreement does not exempt the Insuring Party from the obligation to pay the premium for the period during which the Insurer provided insurance coverage.
- The right of withdrawal does not apply to the Insuring Party if the Insurance Agreement was concluded for a period shorter than thirty days.
6. Complaints
- Complaints containing reservations regarding the services provided by the Insurer should be directed to the Insurer, in accordance with the provisions of the GTC regulating the principles and method of submitting complaints.
- Complaints regarding the Visa Insurance Service should be submitted by email to contact@visa-insurance.eu within 7 days from the event justifying the complaint and must concern the Visa Insurance Service or the provision of services by INS Global. The complaint should include the name, surname, correct email address of the User, a detailed description of the reason for the complaint, and include the word “Complaint”.
- The decision regarding a given complaint is final and binding and will be sent to the User in a reply to the same email address from which the complaint was sent within 30 days from the date of receipt of the complaint.
- In case the complaint is not resolved within the time limit, the User will be informed of the reason for the delay and the expected date of obtaining a response.
7. Intellectual Property Rights
- Since the Visa Insurance Service contains content protected by intellectual property law, in particular, trademarks and other intangible goods that are the subject of copyright protection, the User is obliged to comply with the provisions of intellectual property law.
- The selection and arrangement of the content presented in the Visa Insurance Service constitutes an independent subject of copyright protection.
- The use of content protected by intellectual property law and the disposal of them, if not related to the permitted personal use by the User, requires each time consent.
8. Final Provisions
- The content of the Visa Insurance Service may be changed at any time.
- In the event of irregularities in the use of the Visa Insurance Service, in particular the occurrence of circumstances that could harm the interests of the User, the Insurer, or INS Global, access to the service may be blocked. INS Global is not liable for blocking access to the Service as mentioned above.
- The full content of the Terms and Conditions is made available to the User free of charge via the Visa Insurance Service in a form that allows it to be downloaded, recorded, and printed.
- Each User has the opportunity and obligation to familiarize themselves with the full content of the Terms and Conditions before concluding the Agreement.
- In matters not regulated in the Terms and Conditions, the provisions of the currently applicable Polish law apply.

- The privacy policy is an integral part of the Terms and Conditions and describes the principles of processing information, including personal data and cookies.
- Data is processed based on GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

- Providing personal data is voluntary and is intended to prepare an insurance proposal, and in case of interest, to conclude an insurance agreement and perform the agreement for electronic services. Providing personal data is a condition for the realization of concluding an insurance agreement.
- Personal data is adequate in relation to the purposes for which it will be processed.
- Personal data will be collected in connection with the use of the Visa Insurance Service, to the extent necessary for:
- presenting information, performing the agreement for electronic services, concluding insurance agreements, settling payments, responding to questions sent via the contact form or online chat – the legal basis is the necessity of processing for the performance of the agreement (Art. 6(1)(b) GDPR).
- analysis, statistics, or data administrator services – the legal basis for processing is the legitimate interest in conducting analyses of user activity and preferences to improve functionality and ensure the security of the Visa Insurance Service and services provided through it (Art. 6(1)(f) GDPR).
- product marketing – the legal basis for processing is the legitimate interest in promoting products and services (Art. 6(1)(f) GDPR).
- conducting direct marketing of products and services (only with consent) – the legal basis for processing is consent (Art. 6(1)(a) GDPR), which can be withdrawn at any time. Marketing will be conducted only through communication means (email).
2. Rights of the Data Subject
- Personal data will be processed for the period necessary for the performance of the agreement concluded in the Visa Insurance Service, and after that period for the purposes and for the duration and to the extent required by law or to secure potential claims.
- The data subject has the right to access their personal data and the right to rectify, delete, or limit processing, the right to data portability, and for marketing purposes, the right to object to their processing.
- The data subject has the right to lodge a complaint with the supervisory authority if they believe that the processing of personal data violates the provisions of applicable law.
- The user of the Visa Insurance Service, before indicating the personal data of other persons when concluding an agreement on behalf of another person, should obtain consent to provide it.
- Using the Visa Insurance Service requires processing personal data in the scope of: name and surname, email address, residential address, date of birth, ID document number. The data will be processed by the Administrator to the extent necessary to conclude and perform the agreement. Transaction data, including personal data, may be transferred to PayU S.A. based in Poznań (60-166), at 186 Grunwaldzka Street, KRS: 0000274399, to the extent necessary to handle payment for the order. The customer has the right to access their data and correct it. Providing data is voluntary but necessary to use the Visa Insurance Service.
3. Protection of Personal Data
- Login and data entry points are protected at the transmission layer (SSL certificate).
- To protect data, the Administrator regularly performs backups.
- Data protection includes regular updates of all software used by the Administrator to process personal data.
- The Administrator undertakes to protect personal data in accordance with applicable laws, in particular not to disclose them to third parties and to process them only for the purposes specified in Art. 1 and for their own marketing purposes, subject to Art. 4.
4. Transfer of Personal Data to Other Entities
- Personal data may be transferred to perform services provided through the Visa Insurance Service, to:
- insurers offering their products through the Visa Insurance Service – to present insurance offers, conclude, perform, or withdraw from insurance agreements,
- individuals performing agency activities on behalf of the Administrator,
- hosting companies on a commissioning basis,
- law firms and debt collectors,
- payment operators,
- public authorities,
- online chat solution operators,
- authorized employees, collaborators using data to achieve the website's purpose,
- contractors and suppliers responsible for the maintenance of IT systems,
- companies providing marketing services to the Administrator,
- postal operators, couriers.
- Selected information and personal data may be disclosed to appropriate authorities or third parties who request the provision of such information based on an appropriate legal basis and in accordance with applicable law.
- Personal data is not transferred to third countries within the meaning of data protection regulations. This means that we do not send them outside the European Union.
5. Retention Period of Personal Data
- Personal data processed in connection with the conclusion and performance of the electronic services agreement will be stored for its duration.
- Personal data processed based on consent will be stored until the consent to their processing is withdrawn.
- Personal data processed for marketing purposes based on a legitimate interest will be stored until an objection to their processing for this purpose is raised.
- Retention periods may be extended if the data is necessary to establish, pursue, or defend against potential claims, and after that period only if and to the extent required by law. After the processing period, the data will be irreversibly deleted or anonymized.
6. Significant Marketing Techniques
- The Administrator uses statistical analysis of website traffic through Google Analytics (Google Inc. based in the USA). The Administrator does not transfer personal data to the operator of this service, only anonymized information.
- The Administrator uses remarketing techniques to tailor advertising messages to the user's behavior.
- The Administrator uses the Facebook pixel. This technology causes Facebook (Facebook Inc. based in the USA) to know that a person registered there uses the Visa Insurance Service. The Administrator does not transfer any additional personal data to Facebook.
- The Administrator uses a solution that automates the operation of the Visa Insurance Service in relation to users.
7. Information about Cookies
- The service uses cookies.
- Cookies are IT data, in particular text files, which are stored in the end device of the service user and are intended for using the Visa Insurance Service websites.
- The entity placing cookies on the user's end device and accessing them is the Administrator.
- Cookies are used for purposes specified in Art. 6.
- Web browsing software (web browser) usually allows cookies to be stored on the user's end device by default. Users can change settings in this regard. The web browser allows the removal of cookies. It is also possible to automatically block cookies.
- Restrictions on the use of cookies may affect some functionalities available on the Visa Insurance Service websites.
8. Administrator Logs
- Information about user behavior on the website may be logged. This data is used to administer the Visa Insurance Service.
- The service is hosted (technically maintained) on the servers of the operator: cyberFolks.pl
- The hosting company, to ensure technical reliability, maintains logs at the server level. The following may be logged:
- resources identified by URL (addresses of requested resources – pages, files),
- time of request,
- time of sending the response,
- name of the client's station – identification through the HTTP protocol,
- information about errors that occurred during the HTTP transaction,
- URL of the page previously visited by the user (referer link) – if the transition to the Service was made through a link,
- information about the user's browser,
- IP address information,
- diagnostic information related to the self-ordering process of services through the forms on the site,
- information related to the handling of email correspondence addressed to and sent by the Administrator.

- INS Global is not bound by any agreement to distribute insurance products exclusively for one or more insurers.
- INS Global acts as an insurance intermediary and conducts agency activities for the following insurers:
- Wiener Towarzystwo Ubezpieczeń Spółka Akcyjna Vienna Insurance Group, based in Warsaw (02-675) at 22A Wołoska Street, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw, XIII Commercial Division of the National Court Register under the number KRS 0000033882, with a fully paid-up share capital of PLN 123,630,876.00, REGON: 010594552, NIP: 5240302393.
2. Insurance Intermediation
- INS Global is an active insurance intermediary for Section II (Other personal insurance and property insurance). The activities of INS Global are supervised by the Polish Financial Supervision Authority (“KNF”) based in Warsaw, at 1 Plac Powstańców Warszawy (tel. +48 22 262 40 91, fax +48 22 262 41 08, website: https://www.knf.gov.pl).
- INS Global is entered into the Register of Insurance Agents maintained by the KNF under the number 11256670/A.
- The Register of Insurance Intermediaries, which includes the Register of Insurance Agents, is available online at https://rpu.knf.gov.pl
- The KNF provides information on the entry in the register upon request, submitted orally, in writing, electronically, or by telephone.
3. Remuneration
- INS Global receives commission remuneration for concluded insurance agreements.
- INS Global receives commission remuneration from the insurer on whose behalf it intermediates in concluding insurance agreements.
- This commission is a component included in the insurance premium.
4. Shares and Stakes
INS Global does not hold shares, stocks, or voting rights in any insurance company or the parent company of an insurance company. No insurance company or the parent company of an insurance company holds shares, stocks, or voting rights in INS Global.
5. Complaints
The client has the right to file a complaint, lodge a grievance, and submit a request for the initiation of proceedings for the out-of-court resolution of consumer disputes in the manner specified by applicable law or as indicated by the insurer in the insurance agreement concluded with the client.
